General

1. The following general terms and conditions in their currently valid version apply to all business relationships of any kind between North Trampoline/Avero Handelsgesellschaft mbH HRB16201 (hereinafter referred to as Avero) and the customer. Deviating conditions or general terms and conditions of the customer are not valid unless otherwise agreed in writing.

2. We save the contract text and send you the order data and our general terms and conditions by email. You can also view the general terms and conditions here at any time. For security reasons, your order data is no longer accessible via the Internet.

3. The presentation of the products in the online shop is not a legally binding offer, but only a non-binding online catalog. By clicking the "Order!" button you place a binding order for the goods in the shopping cart. Confirmation of receipt of the order is sent immediately after the order has been sent. We can accept your order by sending an order confirmation by email or by delivering the goods within two days.

4. North Trampoline/Avero reserves the right not to provide the promised service if it turns out after the contract has been concluded that the goods are not available, even though a corresponding hedging transaction has been concluded. In such a case, the customer will be informed immediately. Any consideration already provided by the customer will be reimbursed immediately. Further claims by the customer against North Trampoline/Avero are excluded.

5. Klarna
By making a purchase from us, you agree to Klarna processing the data required for the processing of invoice purchases and an identity and credit check. You can revoke your consent at any time with effect for the future. The retailer's terms and conditions apply.

Order

Orders are placed via our website, in exceptional cases by email or telephone, unless otherwise agreed. Orders placed on behalf of another person without their consent will be reported to the police.

Prices

All product prices are shown in euros including VAT applicable at the time of purchase. Any transport costs incurred are shown separately.

We reserve the right to change product specifications and prices without prior notice. Upon completion of the purchase process, the price shown is confirmed, unless there is an obvious, plausible error.

The discount codes cannot be combined with other current discounts or offers.

Levering

Levering skjer på avtalt sted (leveringsadresse oppgitt i ordrebekreftelsen) med en av North Trampoline utvalgte fraktselskap og debiteres i henhold til gjeldene prisliste. Det er kjøperens eget ansvar å sjekke at adressen og informasjonen som oppgis til North Trampoline ved bestilling er korrekt.

Kjøperen må, etter at North Trampoline har effektuert bestillingen, følge opp leveransen med fraktselskapet.

Kjøperen må se til at leveringen avhentes eller mottas på avtalt sted innen rimelig tid etter at din bestilling har blitt utsendt, normalt f.o.m. 9 dager etter registrert utsendelse.

For leveranse til Svalbard/Jan Mayen må kunder vennligst ta kontakt med kundeservice, da pris må avtales med oss før bestillingen kan effektueres.

Delivery Time

If the goods are in stock, the delivery time for trampolines is 2-5 working days.
If we receive the order by 10:30 a.m., the shipment will be handed over to the shipping company on the same day (Monday to Friday).
Please note that the delivery time may be delayed by 1-2 days on public holidays.

If you choose the "Next day delivery" option (express delivery), delivery will take place the next day on working days (Mon-Fri). No deliveries are made on Saturdays.

Please clarify any special appointment requests with customer service in advance.

Due date and payment

In cooperation with  Klarna  we offer the following payment options. Payment is always made to Klarna.

  • Klarna invoice: Payable within 14 days of the invoice date. The invoice will be issued when the goods are dispatched and sent by email. You can find the invoice terms here.
  • Klarna Installment Purchase: With Klarna’s financing service, you can pay for your purchase flexibly in monthly installments of at least 1/24 of the total amount (but at least EUR 6.95).   • Sofortüberweisung

Cookies
Klarna uses cookies for the “Remember me” function. By using our service, you agree to this.

Invoices from North Trampoline/Avero are payable immediately and without deduction, unless otherwise agreed in writing.

If the customer defaults on payment of the purchase price, the purchase price will be subject to interest at a rate of five percentage points above the respective base interest rate during the period of default. If North Trampoline/Avero can prove that it has incurred greater damages due to the delay, North Trampoline/Avero is entitled to claim these damages.

Guarantee

We offer a minimum of 1 year warranty on all our products, but in many cases the warranty period is significantly longer. However, our corporate customers only receive a warranty on products that are expressly intended for commercial use. All details can be found in the warranty section  .

Right of Withdrawal/Returns

North Trampoline follows the applicable legal basis for consumer protection and also grants its customers a 30-day right of return valid from receipt of the goods. We recommend returning the goods in their original packaging. If the original packaging is no longer available, this may result in a reduction in the value of the goods.

If the product has been used more intensively than is necessary to obtain a basic understanding of the function or properties of the product, the customer must bear the costs of any depreciation of the goods that has occurred while in the customer's possession. If the goods are returned to us in acceptable condition, the full price of the goods will be refunded after the goods have been inspected by our staff.

The return of trampolines/pallet goods is carried out by a shipping company commissioned by us. The customer bears the return costs of 99 euros including VAT. The return costs are offset against the credit for the returned goods (refund including the original freight costs).

A parcel return (GLS) will be charged with the amount of the actual delivery costs, whereby the original freight costs will be credited for a complete return. The return will be made using a return label created by us.

To register a return and before returning the goods, please fill out the return form and send it by email to info@northtrampoline.de. Alternatively, you can register the return directly using our online form at www.northtrampoline.de. Then print out the form and attach it to the outside of the return.

Packages that are delivered to a parcel shop and not picked up by the customer within the collection period and are therefore sent back to our warehouse will not be treated as returns as described above. In this case, the purchase price will be refunded, minus a 20 euro processing fee.

If you have received the wrong delivery, we will of course cover the transport costs.

In the event that something is delivered incomplete or defective, North Trampoline will replace the relevant parts within 2-5 days of receipt of notification or as soon as the replacement part has arrived at the warehouse. The right of withdrawal does not apply to companies.

Complaints

Warranties and claims for damages

1. Defects or damage that are the result of negligent or improper handling or improper installation, as well as the use of unsuitable accessories or modifications to the original parts by the customer or a third party not commissioned by North Trampoline/Avero, are excluded from the warranty. In order to assess the damage, the customer is obliged to send meaningful pictures to North Trampoline/Avero customer service on which the damage is clearly visible.

2. Natural wear and tear is also excluded from the warranty.

3. If the customer accepts the goods or the object of the order despite being aware of a defect, he shall only be entitled to warranty claims to the extent described below if he expressly reserves these in writing immediately after receipt of the goods.

4. The customer is only entitled to warranty claims due to existing transport damage if he has fulfilled his obligation to inspect and report in accordance with Section 2, Paragraph 3. This does not apply if the customer is a consumer within the meaning of Section 13 of the German Civil Code (BGB).

5. The warranty period for new goods is 24 months. The period begins upon transfer of risk. The warranty period for used items is one year. If the customer is an entrepreneur within the meaning of Section 14 of the German Civil Code (BGB), the warranty period for new items is one year and for used items six months from transfer of risk.

6. In the event of damage or defects within the scope of the guarantee, the buyer must grant Avero the right to subsequent performance and fulfil the necessary conditions for this.

7. Otherwise, the warranty is governed by the statutory provisions.

8. North Trampoline/Avero is only liable for damages other than those resulting from injury to life, body or health if these are based on intentional or grossly negligent actions or on culpable violation of a material contractual obligation by North Trampoline/Avero or vicarious agents (e.g. the delivery service) of North Trampoline/Avero. Any further liability for damages is excluded. The provisions of the Product Liability Act remain unaffected. If a material contractual obligation is negligently violated, North Trampoline/Avero's liability is limited to the foreseeable damage.

Sales to Minors

North Trampoline only concludes purchase contracts with adults (aged 18 and over) or with minors with parental consent.

Delivery/transport damage

1. The risk of accidental damage to the goods passes to the buyer upon delivery to the buyer. This also applies to partial deliveries.

2. All prices are cash prices including VAT plus any packaging and transport costs that may apply.

3. The goods must be inspected for transport damage immediately after receipt by the customer or his representative. Any transport damage that can be identified must be reported immediately in writing. The customer must obtain written confirmation of any packaging damage from the transport company upon receipt of the goods.

4. Claims for damages against North Trampoline/Avero due to non-performance or delay are excluded unless there is intent or gross negligence.

Data Protection

1. Liability
North Trampoline/Avero is only liable for damages other than those resulting from injury to life, body or health if these are based on intentional or grossly negligent actions or on culpable violation of a material contractual obligation by North Trampoline/Avero or vicarious agents (e.g. the delivery service) of North Trampoline/Avero. Any further liability for damages is excluded. The provisions of the Product Liability Act and other mandatory statutory provisions remain unaffected.
If a material contractual obligation is negligently violated, North Trampoline/Avero's liability is limited to such typical damages in terms of type and extent that were reasonably foreseeable at the time the contract was concluded.
North Trampoline/Avero is only liable for the actions of partner companies if these are vicarious agents and does not guarantee the availability or freedom from disruption of the services offered under the links. In this case, North Trampoline/Avero also assumes no responsibility or liability for the compliance of the services offered by the partner companies with legal requirements.

2. Copyright
The content of the website www.northtrampoline.de is protected by copyright. The reproduction of information or data, in particular the use of texts, parts of texts or images requires the prior consent of North Trampoline/Avero.

3. Personal data / types of use

2. The exclusive place of jurisdiction for lawsuits against North Trampoline/Avero Handelsgesellschaft mbH is Berlin. Final Provision

Should any of these provisions not be applicable for any reason whatsoever, this shall not affect the validity of the remaining provisions.

Force Majeure

Revocation and Retention of Title

North Trampoline follows the regulations of the German Civil Code §312B (formerly the Distance Selling Act) and grants a right of withdrawal from the date of receipt of the goods, extended to 30 days.

1. The delivered goods remain the property of North Trampoline/Avero until all claims against the customer have been paid in full, including all ancillary claims. In the case of contracts with consumers, Section 13 of the German Civil Code (BGB), North Trampoline/Avero retains ownership until the purchase price has been paid in full.

2. The customer is not entitled to sell the goods to third parties or to take any other measures that endanger the ownership of North Trampoline/Avero until the purchase price has been paid in full. The customer hereby assigns to North Trampoline/Avero any future claims against the purchaser in the amount of the purchase price agreed between North Trampoline/Avero and the customer, including interest and ancillary claims. North Trampoline/Avero accepts this assignment.

Repayments

As a customer, you have the right to get your money back if you exercise your right of return or withdraw from the purchase. The money will be returned within 14 days of receipt of the return to North Trampoline. If you cancel the purchase due to a late delivery or complaint, the amount will be refunded within 14 days of notification that you wish to cancel the purchase.

Claims

As a private person, you have warranty rights for two years from the receipt of the goods when purchasing new products. This applies to defects that result from an original product fault.

Submit complaints as soon as possible after detection of the defect. In the case of complaints received after six months from receipt of the goods, the so-called burden of proof lies with the buyer, i.e. the buyer must prove that the defect was present from the beginning.
